Appeals judge hints at agent sympathy in border patrol case (Ramos and Compean)

A federal appeals court judge yesterday said the government "overreacted" in the prosecution of two U.S. Border Patrol agents who were sentenced to lengthy prison terms for shooting a drug-smuggling suspect in the buttocks as he fled back into Mexico.

"For some reason, this one got out of hand, it seems to me," said Judge E. Grady Jolly, one of the three judges hearing an appeal by the agents before the 5th U.S. Circuit Court of Appeals in New Orleans. "It does seem to me that the government overreacted here."
