DALTON, Georgia -- A Dalton man who is accused of raping a 9-year-old girl on July 11 and who is in the country illegally, according to jail records, has been indicted by a Whitfield County grand jury.
Miguel Francisco Pablo-Garcia, 26, of 516 Candran St., was indicted for rape, two counts of aggravated child molestation, two counts of child molestation, enticing a child for indecent purposes, sexual battery, felony statutory rape, false imprisonment, three counts of forgery in the first degree and two counts of falsifying identification documents.
According to a police report, Garcia entered the child’s house and raped her while her father slept. The report said the girl was an acquaintance of Pablo-Garcia.
Records from the Department of Homeland Security’s Immigration and Customs Enforcement division show Pablo-Garcia, who was born in Guatemala, is not legally in the United States and appears to be subject to removal proceedings, but he has an application for appeal pending, according to booking records at the sheriff’s office.
